Wrongful Death

Some accidents are so terrible that someone may not recover from their injuries. When something terrible like this occurs, the family members who are left behind may be entitled to recover for the loss of their loved one. Initially, one needs to consider whether to bring a claim on behalf of the Estate or on behalf of the statutory beneficiaries. How this claim is brought could affect whether a creditor (a non-family member) has a right to some of the recovery or whether what is recovered can be paid directly to the family.

This is usually a difficult time, and although no amount of money can bring a loved one back, the family is generally entitled to be compensated for their grief and feelings of loss. Funeral and medical expenses, the loss of the relationship among family members, and the loss of the economic benefits that person made to the family are a part of the monetary evaluation that needs to be made to document the impact of the loss of this person on the family.
